GENERAL
◦ I (the Artist) reserve the right to decline any commission for any reason.
◦ You (the Client) must provide clear references and descriptions for your commission.
◦ All communication and agreements must take place through social media DMs (Discord/Instagram/X/VGen).
◦ The Client will receive a Drive Folder containing the following versions/files of the artwork:
- PNG file
- CSP file (Layered Files)
- Transparent PNG version
- PNG file with watermark
◦ These terms may be updated at any time without prior notice. Art commissions that are being processed before the update will NOT be affected.PERSONAL USE
◦ The Artist has the right to use/display the commissioned artwork unless a requested private artwork was discussed.
◦ The Artist will not use the commissioned artwork for selling/merchandise.
◦ The Client may use the commissioned artwork as a profile picture/banner/personal prints with proper credit to the Artist. This goes differently for a Monetized Content commissioned artwork.
◦ The Client may post the commissioned artwork on their social media with proper credit to the Artist.
◦The Client may personally use the commissioned artwork to trace/draw on to practice their skills however posting it online must contain proper credentials to the Artist.
◦ The Client must NOT claim ownership/authorship of the commissioned artwork.MONETIZED CONTENT
◦ The Client must inform the Artist beforehand if the commissioned artwork will be used for monetized content (YouTube, Twitch, TikTok, Facebook pages, stream assets, monetized posts/videos, memberships, ad revenue, etc.).
◦ Purchasing a commission for monetized content requires an additional 50% fee on top of the original/base price.
◦ Monetized content rights only apply to the specific agreed usage discussed between the Artist and the Client.
◦ The Client may use the commissioned artwork for monetized content only after full payment has been completed.
◦ The Client must still provide proper credit to the Artist whenever possible.
◦ The Artist still retains ownership and copyright of the commissioned artwork.
◦ Monetized content usage does NOT automatically include commercial merchandising rights.
◦ The Client must NOT resell, redistribute, mint as NFTs, or claim ownership/authorship of the commissioned artworkCOMMERCIAL USE / MERCHANDISING
◦ The Client must inform the Artist beforehand for any commercial use of the commissioned artwork.
◦ Commercial use includes merchandise, product packaging, branding, advertisements, promotional materials, prints for sale, or any use intended for direct business profit.
◦ The Artist will provide written consent regarding the approved commercial use for the Client.
◦ The Artist will provide an invoice and send updated invoices whenever payments or fees are adjusted.
◦ Purchasing commercial rights requires payment of 2x the original/base commission price.
◦ Commercial use rights only apply to the agreed usage discussed between the Artist and the Client.
◦ The Client must NOT alter, redistribute, resell, or claim ownership/authorship of the commissioned artwork.PAYMENT
◦ Local (PH) Payments can be sent through GCash.
◦ International Payments can be sent through a Remitly Link (Excluding Clients from VGen).
◦ 100% Upfront is required after confirming your commission.PROCESS
◦ The Artist will inform the Client before the sketch will begin.
◦ After the sketch, the Client can request revisions and adjustments if needed.
◦ The Artist will send screenshots of the progress at anytime until completion.
◦ The Client may requests for screenshots of the progress.
◦ A commissioned artwork may be finished within 1-5 weeks or more depending on the complexity.REFUNDS
◦ For any commissioned artwork, refunds are NOT allowed unless both parties agree otherwise. Any concerns or issues brought up by the client will be addressed by the artist in a reasonable manner.
